These Terms & Conditions govern purchases from kinervalabs.com and use of the KINERVA LABS website. By placing an order, you agree to these terms together with our Privacy Policy, Shipping & Delivery Policy, Returns & Refunds Policy and Safety & Use information.
1. Store operator and contact
The store trades as KINERVA LABS. Customer support: info@kinervalabs.com. Mandatory trader-identification information required in your jurisdiction should also appear in the website footer, checkout or order documentation.
2. Eligibility and acceptable use
You must be legally capable of entering a purchase contract in your country. You may not use the website for unlawful activity, attempt to interfere with its security, submit malicious code, scrape the site in a way that disrupts service, or misuse another person’s payment or personal information.
3. Product information
We aim to describe products accurately. Product colors may appear slightly different because of screen settings, lighting or manufacturing variation. Measurements are approximate unless stated otherwise. Packaging may change while the underlying product remains materially equivalent.
4. Wellness and medical disclaimer
KINERVA N1 is marketed as a manual self-massage and muscle-comfort tool. It is not intended to diagnose, treat, cure or prevent disease and is not a substitute for professional medical advice. Stop use if you experience sharp pain, dizziness, numbness, weakness or unusual symptoms. Customers with recent injury, whiplash, significant cervical/spinal conditions, neurological symptoms or other medical concerns should seek professional advice before use.
5. Orders and contract formation
Submitting an order is an offer to purchase. We may accept the order by sending an order confirmation or beginning fulfilment. We may cancel or refuse an order before fulfilment where there is a pricing error, suspected fraud, payment failure, stock problem, delivery restriction or other legitimate reason. If we cancel an order after payment, the affected amount will be refunded.
6. Prices, currency and taxes
Prices shown on the website are displayed in the currency selected or shown at checkout. Taxes and other mandatory charges will be displayed where applicable before the order is submitted. Standard Delivery is charged at $5.99 per order. Where import duties or local charges are not collected at checkout, the recipient may be responsible for them unless the checkout specifically states otherwise.
7. Payments
Payment is processed through the payment methods available at checkout. Payment providers may perform fraud, authorization and identity checks under their own terms and privacy policies. We do not guarantee that every payment method will be available in every country.
8. Shipping and delivery
Delivery timeframes are estimates, not guaranteed arrival dates. Orders may be fulfilled by third-party logistics or supplier partners. Please provide a complete and accurate delivery address. See our Shipping & Delivery Policy for processing estimates, tracking and delayed-package procedures.
9. Cancellations
If you need to change or cancel an order, contact info@kinervalabs.com as soon as possible. We will try to help, but once an order has entered fulfilment or been dispatched it may no longer be possible to cancel it. Mandatory consumer cancellation rights remain unaffected.
10. Returns and refunds
Our standard return process is described in the Returns & Refunds Policy. Nothing in these terms limits rights you cannot lawfully waive, including statutory rights relating to defective, misdescribed or non-conforming goods.
11. Promotions and discount codes
Promotions may have separate eligibility rules, expiry dates or quantity limits. Unless expressly stated otherwise, discount codes cannot be combined, exchanged for cash or applied retroactively to completed purchases. We may end or correct a promotion where a technical or pricing error has occurred.
12. Intellectual property
The KINERVA LABS name, website design, branding, original text, graphics and other protected materials are owned by or licensed to us and may not be copied, republished or commercially exploited without permission, except as allowed by law.
13. Reviews and user content
If you submit a product review, photo or other content, you confirm that it reflects your genuine experience, that you have the right to submit it and that it does not violate another person’s rights. We may moderate unlawful, abusive, irrelevant or fraudulent content. We will not knowingly label a review as verified unless we have a reasonable basis for doing so.
14. Website availability
We aim to keep the site available and accurate, but we do not promise uninterrupted operation. Maintenance, provider outages, updates or circumstances outside our reasonable control may temporarily affect the store.
15. Liability
To the maximum extent permitted by applicable law, we are not responsible for indirect or unforeseeable losses caused by use of the website or products where such losses were not reasonably foreseeable when the contract was made. Nothing in these terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights or liability for fraud, intentional misconduct or personal injury where exclusion is prohibited.
16. Events outside reasonable control
We are not responsible for delay caused by events outside reasonable control, including carrier disruption, customs delays, severe weather, natural disasters, labour disputes, war, governmental action, network outages or supply-chain interruption. We will take reasonable steps to reduce the impact where possible.
17. Governing rules and consumer protections
These terms are interpreted under the law applicable to the merchant operating KINERVA LABS, subject to mandatory consumer protections that apply in the customer’s country of residence. Nothing here removes rights that applicable consumer law does not allow a trader to exclude.
18. Changes
We may revise these terms for future orders. The version in effect when you place an order generally governs that purchase unless a change is required by law.
